Contest “Win back the sun”
CONTEST RULES
(hereinafter the “Rules”)
The competition “Win back the sun” (hereinafter the “Contest”) is organized by Transat Tours Canada Inc. doing business as Transat (hereinafter the “Organizer”). The Contest runs from November 1, 2024, at 0:01 a.m. EST (hereinafter the “Contest opening date”), and ends on November 5, 2024, at 11:59 p.m. EST (hereinafter the “Contest Closing Date”).
1. ELIGIBILITY
The Contest is open to all residents of Canada who have reached the age of majority in their province or territory of residence on the Contest Opening Date, with the exception of employees, agents and representatives of the Organizer, its subsidiaries, affiliates, advertising or promotional agencies, suppliers of material, prizes and services related to this Contest and any other party directly involved in the holding of the Contest, as well as members of their immediate families, fathers, mothers, brothers, sisters and children, their legal or common-law spouses and all persons with whom such employees, representatives and agents are domiciled.
2. HOW TO PARTICIPATE
2.1. No purchase necessary
2.1.1 No purchase necessary. The “Win back the sun”contest is an online contest. It is open to residents of Canada who have reached the age of majority in their province of residence at the time of registration.
2.1.2 Participation in the contest by completing the entry form on airtransat.com, without making a purchase, is possible, provided all required fields of the form are completed between November 1 and November 5, 2024.
3. PRIZE
Two (2) prizes (the “Prizes”) will be awarded.
The proposed prizes (hereinafter the “Prizes”) consist of 2 prizes with a total approximate value of $14,000.
Prize 1
- Round-trip Economy Class airfare to Punta Cana (PUJ) in the Dominican Republic from YUL (Montreal) or YYZ (Toronto)
- Round-trip transfer from Punta Cana (PUJ) airport to hotel
- Accommodation for two adults at the Serenade Punta Cana Beach & Spa Resort for 7 nights.
- All-inclusive meals, drinks and activity programs
Prize 2
- Round-trip Economy Class airfare to Punta Cana (PUJ) in the Dominican Republic from YUL (Montreal) or YYZ (Toronto)
- Round-trip transfer from Punta Cana (PUJ) airport to hotel
- Accommodation for two adults at the Serenade All Suites Adults Only Resort for 7 nights.
- All-inclusive meals, drinks and activity programs
Each prize has an approximate retail value of seven thousand dollars ($7,000 CAD) for a total of fourteen thousand dollars ($14,000 CAD) in prizes.
4. CONDITIONS ATTACHED TO THE PRIZES
4.1. Reservations are subject to the availability of Transat Tours Canada at time the reservation. The terms and conditions of the Air Transat brochures apply. Insurance costs, personal expenses, personal travel insurance, and travel documentation are not included in the Prize. The Organizer strongly recommends that the selected Participant take out travel insurance at the time of booking.
4.2. The prizes are offered in the form of a certificate. Winners will be contacted by Transat in order to make a reservation and must complete their trip before October 31, 2025.
For both hotels, reservations cannot be made during the following periods:
- Christmas period – December 14, 2024, to January 12, 2025
- Easter weekend – February 21, 2025, to March 23, 2025
- Memorial Day weekend – May 25, 2025, to May 27, 2025
- Independence Day weekend (U.S) – July 4, 2025, to July 7, 2025
4.3. The Prize offered must be accepted as offered and is not exchangeable, refundable, transferable, or redeemable for cash and no extension of the validity date is permitted;
4.4. The winner (and the passenger of their choice, if applicable) must have the same departure and return dates respectively on the plane tickets;
4.5. The winner and his/her guest are responsible for paying all additional taxes, costs, and fees of any kind relating to their prize (including travel expenses from the residence to the airport, seat selection and airport fees applicable) and any other charges that may be added, including, but not limited to, additional ground transportation (including airport, arrival and departure transportation, other than this which has been agreed), taxes, transport, repatriation and medical insurance, personal expenses, tips, meals, and entertainment activities. Any upgrade (air travel or room) or addition of ancillary products (e.g.: Option Plus, baggage, seat selection, etc.) are extra and must be paid for by the winner. Any modification to this package will be the sole responsibility of the winner;
4.6. Reservations and travel arrangements must be made by the winner. Reservations are subject to availability. They must be made at least 120 days before the departure date for a trip between January and April 2025, and at least 30 days before the departure date for a trip between May and October 2025 and may not be changed under any circumstances. The winner must book his/her trip with Transat.
5. DRAWING
The contest draw will be held on November 11, 2024, at 10 a.m. (EST) at the Air Transat offices at 300 Léo Pariseau, Suite 1000, Montreal (Quebec) H2X 4C2.
A total of two (2) random draws will be made among all the web forms completed before the Contest Closing Date.
One winner will be drawn for the province of Quebec and one for the province of Ontario.
6. PRIZE CLAIMING
6.1. In order to be declared a winner, the selected Participant must:
6.1.1. Be reached by email or telephone by the Contest Organizer within five (5) business days following the draw and answer the mathematical skill-testing question that will be asked. If it is impossible to reach the selected Participant by phone or email within seventy-two (72) hours of the draw, for whatever reason, all rights to the prize will be forfeited and the Organizer will proceed with a new draw. If it is impossible to reach the second (2nd) Participant selected by phone or email within seventy-two (72) hours of the second (2nd) draw, all rights to the Prize will be forfeited and the Organizer will proceed with a new draw. If it is impossible to reach the third (3rd) Participant selected by phone or email within seventy-two (72) hours of the third (3rd) draw, the prize will be forfeited.
6.1.2. Complete and sign the declaration and exemption form (hereinafter the "Declaration form”) which will be sent to them by the Organizer and returned to them within ten (10) working days of receipt thereof.
6.2. The designation of the winners will be made no later than November 22, 2024.
6.3. Failure to comply with one or other of the conditions mentioned above, or any other condition provided for in these Rules, will result in the selected Participant being disqualified and the Prize awarded to him/her will be forfeited. In the days following receipt of the duly completed Declaration Form, the Organizer responsible for administering the Contest will contact the selected Participant to inform them of how to claim their prize.
7. PERSONAL INFORMATION
7.1. From time to time, the Organizer may, with the consent of the Participant, use the personal information provided by the latter, for the purpose of:
7.1.1. Communicating with the Participant so that he/she takes possession of the prize;
7.1.2. Communicating directly with the Participant regarding the products and services offered by the Organizer, including special offers and information on travel services; and
7.1.3. Conducting a survey regarding the effectiveness of the website, advertising, and sales efforts made by the Organizer
7.2. The Participant must indicate whether or not they consent to the use of their personal information by checking the box to that effect on the official entry form, or by indicating it on the handwritten entry form sent by the post office. To obtain further information regarding the use of personal information by the Organizer, as described in the Policy on the protection of personal information and respect for privacy adopted by Transat AT inc. and its affiliated companies, the Participant is invited to visit the websites www.airtransat.com and or www.transat.com.
8. TERMS AND CONDITIONS
8.1. The Contest Organizer reserves the right to disqualify a Participant or to cancel their participation if they participate or attempt to participate in this Contest in a manner that does not comply with these Rules. This Participant could be entrusted to the competent judicial authorities. Any decision by the Contest Organizer with respect to this aspect of the Contest is final.
8.2. By participating in this Contest, the selected Participant consents, without receiving additional compensation, to the use of their name, address, city, province, voice, comments, photographs and/or other likeness for advertising or promotional purposes by the Organizer.
8.3. This Contest is subject to federal, provincial, and municipal laws and regulations.
8.4. Incomplete entries, entries received after the Contest Closing Date, lost, incorrect in any way or sent by an unauthorized method are deemed void and will not be accepted in the draw.
8.5. The Contest is managed by the Organizer. The Organizer will not assume any responsibility for any problem or failure of network, computer online system, peripheral telephone, software, server, provider, email, browser, or for any technical problem which may occur, including but not limited to a transmission or non-transmission problem, regardless of the cause. The Organizer is in no way responsible for the circulation of erroneous or inaccurate information, whether caused by users of the website or by the equipment and/or programs associated with or used by the Contest, or because a technical or human error that may have occurred during the course of the Contest. The Organizer assumes no responsibility for any error, omission, interruption, loss, defect relating to the operation or transmission, breakdown of communication lines, theft, or destruction. The Organizer is not liable for any injury or damage that may result from the holding of the Contest. The Organizer reserves the right to destroy all documents relating to the Contest once the retention period required by law has expired. The Organizer reserves the right, at its sole discretion, to cancel, modify or postpone the Contest at any time, without notice, if any factor prevents the Contest from being conducted under these Rules or in compliance with any law, regulation or policy of any entity having jurisdiction over the Organizer. It should be noted that general conditions apply to this reservation (please consult the current Air Transat brochure);
8.6. In the event of an unforeseen event, Transat reserves the right to modify the dates of the trip by a few days after informing the winner;
8.7. Transat reserves the right to offer a comparable product in the event of program cancellation, force majeure or any other situation beyond Transat's control without any possible recourse from the winner and/or his/her companion;
8.8. Any necessary travel documents (passport, visa, etc.) are the responsibility of the winner (and passengers of his/her choice, if applicable); he/she must obtain them before departure;
8.9. In the event that the winner’s guest is a minor, and the winner is not their parent, the parent or legal guardian must sign the declaration form and accept the invitation on his/her behalf so that minor can take part in the trip;
8.10. In the event that the winner and their guest do not use part of the prize, no compensation of any kind will be paid to them;
8.11. The market value of the prize is in Canadian dollars ;
8.12. In the event of loss, theft, mutilation, alteration, or unauthorized use of the prize, it will not be refunded or replaced.
8.13. The contest promoters are not responsible for delays or cancellations concerning the prize, which may occur before or during the trip. Any loss or theft of tickets, certificates, or any other property will not be compensated ;
8.14. By participating in the Contest, the Participant acknowledges having read and understood these Rules and agrees to be bound by them and to comply with them. The Participant certifies that the Rules are understandable and reasonably available for consultation.
8.15. The names of the winners can be obtained by writing to the Contest "Win back the sun”, Air Transat, 300 Léo Pariseau, Suite 500, Montreal (Quebec) H2X 4C2, to the attention of Camille Martel.
8.16. A dispute regarding the organization and conduct of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux (hereinafter the "Management") so that it is decided. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping to reach a settlement.
