Acceptance of Terms
The following Terms apply to any instant purchase ("Offer") you submit to Air Transat for the opportunity to travel with Air Transat in Club Class ("Upgrade").
To purchase an Offer, you must (i) have reached the age of majority in your country of residence at the time the Offer is submitted; and (ii) have purchased a seat eligible for an Upgrade on a scheduled flight operated by Air Transat (Instant Purchase). You are deemed to be authorized to act on behalf of the person(s) named or included in the Offer governed by these Terms and to have the authority to bind such person(s). Your upgrade offer
Purchases can only be made on certain flights operated by Air Transat and in certain countries, as determined by Air Transat in its sole discretion. When you check in online, you will have the opportunity to upgrade by making an Offer if unsold Club Class seats are still available for that flight.
Any Offer you submit as part of a reservation with Air Transat, whether made directly with Air Transat or indirectly through another reservation channel (via call center or airport counter), entitles the person(s) named on the Offer, subject to these terms and conditions, to be considered for an Upgrade.
Acceptance of the Upgrade Offer
Upgrade Offers are strictly personal, non-transferable and must be accompanied by full payment prior to confirmation. When upgrading on certain flights, you may be asked to provide certain information from your passport. Confirmation of prices, travel dates, flights, hotels, car rentals and other services, where applicable, is only given once payment has been received and is based on availability. Once the check-in process is complete and full payment has been received, you will receive an email confirming that your Upgrade has been accepted and summarizing all the details of your flight(s).
Flight modification or cancellation
If Air Transat cancels a flight and reroutes you on another flight, it will use reasonable commercial efforts to transfer your Offer to the new flights, subject always to the availability of seats in the higher class of service or the availability of that higher cabin class. The Offer is not transferable. If, for any reason, there are insufficient seats available in the higher class of service to grant you an Upgrade, all amounts paid by you for the Upgrade will be refunded to the credit card on which the Upgrade was paid, and Air Transat will have no further obligation to you.
If you change your flight reservation, Air Transat is not obligated to upgrade you on the changed flight unless you pay for the upgrade in accordance with Air Transat's standard change policies and the policies and conditions associated with the original fare class. You will not be entitled to a refund of the cost of the upgrade, and the upgrade cannot be transferred to a flight operated at another time or to another customer. Payment
If Air Transat accepts your offer, depending on the method of payment used, the total amount of the offer will be charged to your credit card, upon acceptance of the offer, and Air Transat will issue an upgrade to all customers included in your offer. The total amount charged to your account will include taxes and fees applicable to the upgrade (if any). You may not assign or transfer, in whole or in part, an upgrade that has been accepted by Air Transat to another person or flight.
There will be no refund, credit, or exchange once Air Transat has accepted your offer or upgrade, except in the following cases:
- i) Your Upgrade was accepted for a flight, but that flight was subsequently cancelled and Air Transat or the Carrier rebooked you on another flight, but in the class of service of your original reservation.
- ii) Your Immediate Upgrade was accepted and you were upgraded, but you were unable to obtain a seat in the higher class of service for reasons attributable Air Transat, including, but not limited to, an aircraft change or a delay in your connecting flight that prevented you from taking the flight for which you had been upgraded,
- iii) If your Offer has been accepted, but you were unable to obtain a seat to which the Upgrade applies for reasons attributable to the Carrier, including a change of aircraft or a delay in your connecting flight that prevented you from taking the flight for which you had been upgraded, the refund (depending on the method of payment, e.g. credit card) will be made to you.
If the refund is approved, the amount paid for the Upgrade will be credited to the account of the payment card used to pay for the Upgrade. Credit card payments and refunds will be processed in the currency in which the Upgrade amount was billed. If an exchange rate must be applied to process the refund in the currency originally applied to the Upgrade amount charged, a generally accepted rate will be used, as determined by Air Transat, at its sole discretion. This rate may be modified to consider conversion and other costs. The amount refunded may in no case exceed the amount billed in the original currency for the Upgrade.
Fare rules
The fare conditions of the original ticket you purchased remain in effect and apply even if your Offer has been accepted, including cancellation policies, change fees, minimum or maximum stay conditions and point accumulation rules, in accordance with the Conditions of Carriage and Fares. All other terms and conditions will apply according to the fare class for which you are upgrading.
Flights offered by Air Transat are operated in accordance with the applicable tariff and Canadian Transportation Agency regulations. All such flights and fares are also subject to approval by the appropriate government authorities. Consolidations and changes in the published schedule, aircraft type, days of operation, air carrier providing air transportation and flight itinerary may occur beyond the control of Air Transat at any time and without Air Transat being able to give advance notice to its customers.
Protection of personal information
Air Transat is committed to respecting your privacy. The protection and confidentiality of the personal information you entrust to us is of particular importance to us, and we intend to do everything necessary to maintain the trust you have placed in us in this regard.
Your personal information is collected, used and shared by Air Transat within Transat A.T. Inc. and its affiliates for the purposes described in our Privacy Policy.
Liability
Air Transat shall not be liable to you, in contract or otherwise, for any direct, indirect, incidental, special, or consequential damages that result from your use of this website or that result from any information obtained or upgrades made through this website.
Air Transat shall not be liable in any manner whatsoever for the acts or omissions of any third-party supplier.
Laws
These Terms and Conditions shall be governed by and construed in accordance with the laws of the country in which the Gateway City is located.
The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement, which shall remain in full force and effect.
Updates
Air Transat may modify these Terms at any time. Air Transat will notify you of any changes by posting an updated version of the Terms on its website. If you apply for an Offer after Air Transat has made changes to its Terms, this means that you have accepted the changes and agree to be bound by the Terms as amended.
